When companies based outside the EU/EEA/Switzerland post employees to Austria for short-term assignments, they must obtain work authorization from the Austrian Public Employment Service (AMS) and ensure posted workers hold valid Austrian visas. Unlike EU-based postings, third-country postings require direct AMS work permits in addition to proper visa documentation.

Work authorization requirements

Companies based outside the EU/EEA/Switzerland posting workers to Austria must obtain work authorization directly from the AMS:

  • Posting Permit (Entsendebewilligung): Required for postings up to 4 months
  • Employment Permit (Beschäftigungsbewilligung): Required for postings exceeding 4 months (but still under 6 months)
  • Construction sector: Employment Permit always required regardless of duration

The Austrian client or receiving company files the AMS application.

Visa requirements

Working Visa C (Schengen Short-Stay Visa):

For postings up to 90 days within a 180-day period, third-country nationals require a Schengen visa unless their nationality permits visa-free entry. Visa C applications are filed at Austrian embassies or consulates in the worker’s country of residence.

Working Visa D (National Visa):

For postings exceeding 90 days but under 6 months, workers require a Visa D for gainful employment. This national visa permits stays from 91 days to 6 months and must be obtained before entering Austria.
