Who this is for

  • Companies posting third-country nationals to Austria for assignments exceeding 6 months
  • Multinational groups transferring non-EU employees to Austrian operations long-term
  • Service providers managing extended projects requiring non-EU technical staff
  • HR and legal teams coordinating long-term cross-border work authorization and residence

Work authorization requirements

Companies based outside the EU/EEA/Switzerland posting workers to Austria for more than six months must obtain an Employment Permit (Beschäftigungsbewilligung) or directly from the AMS. The Austrian client or receiving company files the application demonstrating the posting arrangement and compliance with Austrian labour standards.

Residence permit requirements

Temporary Residence Permit – Posted Workers (Aufenthaltsbewilligung Betriebsentsandte):

Third-country nationals posted to Austria for more than six months require this residence permit, which combines residence rights with work authorization for the posting duration. The permit is typically issued for up to 12 months and may be extended if the posting continues. Requirements include:

  • AMS work authorization
  • Adequate accommodation meeting Austrian standards
  • Sufficient means of subsistence
  • Health insurance coverage for all risks in Austria
  • All general residence permit requirements

Applications are filed at Austrian embassies or consulates in the worker’s country of residence after AMS authorization has been secured.
